If you do a driver awareness course the police make more money for there budget . If it's a court fine, they will get very little or none. If the lady decided to take it to court she would get off. And the police know this and that's why they dropped the charges, they don't know what to do when a person says no to the driver awareness course.

Do you have any proof of this, or is it just an oft-repeated myth.

 

The reason i ask is that i took one 3 years ago. The course was the same price as the (then) £60 fine, and although I was caught in one Police Authority area, I opted to take it in another close to home.

Although the one I attended was nominally run by the local County Council Road Safety Partnership, the course itself was actually delivered by the AA

 

I believe that ACPO reckoned a couple of years ago that they didn't (and weren't allowed) to make a profit out of the scheme, but only to cover their costs.

It it worth me contesting this as I've had a letter through this morning which could be goodbye to my licence.

If it's that bad then you will need to plead your case in every way possible!

I'd certainly be asking for photos and go from there, this has certainly made me wonder how the cameras work and are they maintained.

It might even pay you to ask for a court appearance to put forward any mitigating circumstances.....

Worthwhile possibly taking legal advice on it if your license is in jeopardy.

Having someone on the inside I can confirm the reason courses are pushed if you're within thresholds is because the government gives forces extra cash for everyone going on one of circa £100 a time.

Never heard of anyone declining. I'd assume you simply got points instead

So she opted for 3 points + the fine (£100) 

The 10% plus 2 is just a guideline, it does not have to be followed. Any force in the UK can prosecute you for doing 31 in a 30 should they so chose, nothing is written is statute that says they cannot do you for speeding until you are doing 35 in 30, otherwise everyone would just drive at 34mph all the time.

 

Its a common misconception that the 10%+2 is set in stone, its just an ACPO recommendation and not law.

 

There must have been another technicality, in England a number of speeding cases have been cancelled near where I live because of issues with camera approval/use. On the M25 there were issues with the font of the variable speed signs not being correct which had the same result

 

Wrong!   There is a valid reason why police allow a degree of tolerance, if they didn't, the courts would probably throw out cases that were reported close to the speed limit.   By applying the rule of thumb 10% +2 mph, the police make sure that the offence will stick.   Similarly, drivers convicted of very marginal transgressions may end up making claims for corporate responsibility against the motor manufacturer for providing a vehicle with inaccurate speed reading.

 

Most speedometers have tolerances of some ±10%, mainly due to variations in tyre diameter Sources of error due to tyre diameter variations are wear, temperature, pressure, vehicle load, and nominal tyre size. Vehicle manufacturers usually calibrate speedometers to read high by an amount equal to the average error, to ensure that their speedometers never indicate a lower speed than the actual speed of the vehicle, to ensure they are not liable for drivers violating speed limits.

 

This way, if you do decide to break the speed limit, you know you are doing so which makes it a fair cop!

 

 

PS   After writing this, I have been pondering my own case from early this year.   I got done twice by average speed cameras on motorway road works, one I had the Speed Awareness Course for and the other I picked up the points for.   The first offence, I was booked at 57 mph (a fair cop), the second was allegedly 64 mph (which I know wasn't true.)   Due to the error of my ways, I incorrectly thought the cameras were set at 60 mph so made certain that at no time did my speedo go over 60.)   However, the mere fact that I was[/b/ deliberately flouting the law means it was fair - even at 4.45 am after a night shift when the motorway was quiet and the road works men have packed up makes no difference.

 

I must admit, when I got booked and paid the fine I did feel hard done by.   The Speed Awareness Course definitely makes you see things in a different light and I understand now why "marginal" speeders are offered this as an option.

My info has come direct from traffic officers. And as for profit, it's easy to show you made none even the police.

Do you know if your wife signed the form before returning it with her licence?

 

A colleague of mine at work did the same (forgot to sign the letter) and the Police were unable to pursue the NIP.

It possible they didn't get the form with the licence as the PO sorting office had the licence for a few weeks. They "found" it apparently, not sure happened there. 

 

 

She spoke to the PO last Wednesday and they passed it on, and that turned up monday, so whatever happened it was quick.

NIP has been modified to include the wording that it is a criminal offence not to sign the NIP document. My daughter just got done for 54 in 40 at the J33 M4 roadworks.
