the garage just called they dont want to take my car as px now, as its an import !!!!!!! can they do this as i have paid the deposit already and agreed the values of both cars. isnt this now a legal contract between us and dont they have to honour this deal. when in the dealers he asked if it was full uk spec and i said yes because it is. its from holland but he didnt ask if it was an import untill today ??

I guess it depends what the contract says.....? Did you specify the value and spec of both cars on the form you signed?

You dont need to tell them unless they ask you. They obviously forgot to ask the question, although with nothing in writing it will be difficult to prove. I guess you will need to sell privately, as long as you get more than the dealer offered you, all should be ok.

That as may be, he wasn't fully aware of the full history of the car, and you didn't volunteer the information. The agreement on the car's value was on a non-import version, if it's an import that affects the value and it is essentially no longer the same car which was discussed...

Sadly, without a written contract it's pretty hard to prove what was agreed to, etc. The best you can do is tell them that you no longer want to deal with them and you want your deposit refunded and see if they bend over backwards to try and do a deal. I suspect with the way the Furby is selling at the moment though, they won't be too bothered...... :(

Mate I am tending to side with Rob on this one, besides he would of said f'off if it came to light after HPI check that the car had been involved in an accident or the like, besides he will just say it's your word against mine for the verbal agreement and there would be a stail mate unless you had an independent witness or the phone calls where taped ???

But if your car had been sold to you by a dealer at book price as "full UK spec", and there was no mention to you of it being imported...wouldn't you be rather disgruntled when you found out otherwise?

yes but i made sure i asked !!!!!!!! there is no excuse for not been on the ball ffs he worksin the industry so should know to ask if its an import or not surely it looks like he is just trying to cover his ass

Problem is line an import up, and line a similar UK car up people won't take the import unless it's cheaper. Unfortunatly it's a catch 22 situation with whether you should have told him or not after all you should have told your insurance company as always! The Fully UK spec question might cover it though as he car may have small differences undetectable to the eye on a casual glance. I suppose he has the right to refuse to purchase it in the same way as an HPI check as he now has more history on it.

If selling it privately isn't happening time to go to an auction or dealers?

Undoubtedly...but that's what keeps a roof over his family's head, so why not?

Are you perhaps valueing your car too highly? If it hasn't sold after 3 months, there might be a case for putting the price in lower, seeing if you get a bite, and if you can blame a printing error to get the price near where you want.... ;)

Dealers always value cars too low, so an auction with a reverse near your target price may be an idea.

I would tend to agree with Rob and Colin on this one. Just tell them you no longer want to go through with the deal and take your business elsewhere. Then come clean if asked about the history of the car somewhere else.

Just a point though and I don't know the full history of your current car but people buy imports because they are (sometimes) significantly cheaper than UK sourced vehicles. To expect come trade-in time a dealer to give you the full market value is not going to happen and why should they... JMTPW.

When I traded in my EU Import Impreza for the vRS, I got the same px price as I would have with a UK car. At the end of the day it depends on how much the dealer wants to sell the car. With a car like a Furby vRS, where demand outstrips supply, he can choose to be picky.

I think you should have told the dealer that the car was an import for starters though.

i have told every dealer before but they have always asked !!

my car silver clio 172 with 41k on the clock fsh etc etc. i paid 10995 for with 12700 on the clock last march (2003) it was an 02 plate registered about june i think.

the car was up for sale at 7k !!! so not exactly too high i have 7300 left to pay off on personal loan so i dunno im just fooking gutted

Bad look mate. Looks like you might have to bite the bullet and lower the asking price of the 172 and prepared to loose a grand or two. :eek: This I lost around
