And I'll happily let the thousands of paid insurance fees over my time driving work there magic and decide what rules apply and what doesn't and come up with the right answer.

There's nothing I can do really.

What happened happened and my account of it is as per the above.

Flashing your lights to let someone out does not give them any legal right of way.

Flashing lights by the highway code is to make other roads users aware of your presence and nothing else.

Well that's what I was led to believe anyway.

Can you not do a minimal strip down ? E.g. take out stereo, replace with crap (even broken) standard stereo.

Take off turbo, replace with KKK turbo

(so long as its technically a runner but in the state its in, I doubt thats even important TBH so long as all the bits are still there and you aren't technically causing any fraud). Ignore the above its YOUR car !!!

 

In fact I will say YES you bloody well can do that and ignore what anyone else has said above. I wouldn't remove anything that was damaged by the accident but anything you wish to salvage, do so.

 

Can anyone help you with any kind of Fabia standard seats at all so you can switch for the recaros - just in case you want to port them into your next car for instance?

I'm not gunna go round and round in circles arguing/discussing things that I can't make a difference to.

It's in the hands of the insurance people now and they can deal with it.

As far as I am concerned I have done nothing wrong, I drove like any normal person would drive and she drove in the side of me.

I shall keep the thread updated as things progress....

Yes I knows its leggy and it's electrics will melt but that many miles in that short a time says motorway to me, and full service history and 12 month warranty...what's not to like?! ;)

My folk's Clio of around the same age has already said 'Sacre Bleu', thrown it's arms in the air and decided to put on a mobile disco show on the dash every few months. It will be their last Renault having owned them for a couple of decades. The last one literally fell to bits, with the rear suspension collapsing on the motorway.

 

A Megane might be a completely different kettle of fish though, plus I don't think my folks are the best at looking after their cars.

 

Even so, the fact they asked if I'd been doing well with work, as they were surprised I could afford "such a spacious, and comfortable car" after giving them a lift back from near Chester after a holiday (the coach dropped them there) up the M6 to Oldham, says it all for me  :giggle:

Inevitably these days insurance companies tend to go to the 50-50 decision almost straight away, to avoid court action.

I would also wager that she puts in a claim for whiplash...

A traffic cop friend of mine accidentally bifffed a bloke up the rear (ooh matron!) at a roundabout on the edge of the M1

Witnesses say speed was perhaps 1-2mph

The guy he hits gets out and starts falling around clutching his neck like he's been shot, until said friend tells him he's a cop and that he is likely committing or attempting to commit a fraud. Basically he tells him to stop being such a ****.

Fast forward 12mths, friend goes to re-insure his old Audi on classic insurance, and his premium has increased by 25%

The broker, a friend of ours, informs him that the other driver DID claim for whiplash, even though it was clear in the witness statements that the accident happened at 1-2mph, and that he had no real injury.

Said ****house got paid out, wait for it... £9500

Thank you insurers for protecting those of us who don't cause accidents or make fraudulent claims....

Absolute disgrace! My girlfriend has an ongoing claim from our accident in June (another red Fabia vRS written off). She's been off work for 7 months due to a back injury, no exaggeration, completely genuine. Was offered £1800 before Christmas. Really gets on my nerves these chancers getting loads and genuine claimants getting **** all, what a broken system.

Never mind T cut, can't believe we've got this far and nobody's mention a dash-cam... :giggle:

Actually helped my mum renew her insurance and similarly a guy scammed like that and the total payout was over £10k on one of her claims (against her, despite it wasn't really her fault and was more tit for tatt, but her age went against her - another DISGRACEFUL incitement of the totally corrupt insurance industry - SHAME ON YOU ALL in insurance.

Utterly disgraceful. Its the scummy lawyers, solicitors and claim culture that has everything to answer for on this.

 

Anyone who claims whiplash is a **** of the highest order too. I got knocked off a bike, chucked down the road and chucked on my front hitting my knee and head, plus bike written off, about 10 years ago and I got less than £5k compensation for EVERYTHING.

 

Back to Pastys car - after all the work its such shame to let the car get replaced - hope you keep it and hope everyone on here can pull together to help you fix it.

Your own insurance company has a duty look look after your interests. You are after all paying them... And they have a code of business and/or/maybe :) ethics.

 

ATEOD the road was not clear and she proceeded pull out into obvious traffic and to drive into the side of the Pasty wagon. She's either 1) Blind, 2) his ex! (boiler bunny)  3) looking to see if the road was clear from the left, thus not looking at the threats she already knew were there.

 

If Mr Pasty wanted to be difficult he could report her for careless driving and complain of neck pain. Not that I suggest he does the latter. IMO Mr Pasty should rigorously promote the physical evidence, remind his insurers of their duty to him and reliably repeat his statement of the events. (Write it down, keep a copy availble).

 

Another angle is to cite the case to the local MP or council. Getting the road/junction improved is a plus... but might be justa tad embarrassing for her and her employer if it reached the ears of the press.

Just reading the above and all I can say about this flashing the lights business, is that when some one flashes me out I still check and won't pull out unless I can clearly see that nothing is coming !

Was a weird weekend, have felt fine physically and come to terms with events mentally but i woke up super early both Saturday and Sunday mornings with my mind racing.

"how can they fight liabilty?"

"was i in the wrong?" 

"if they do settle how will my premiums be affected?"

"what do i do next?"

"what kind of payout will i get?"

"what can i replace it with?"

"how much will they want from me to buy it back?"
"how do i make sure i get the value of the mods back?"

"will it be it worth breaking it?"

"can i be bothered to break it?"

"do i buy another Fabia or Ibiza so i can make use of the mods if i do get them back?"

 

In the end i decided there were just too many questions to answer so stopped thinking about it completely.

 

Moving the story forwards I hadn't heard anything from the insurance today so gave them a call to see what's what as was told that potentially if they are fighting liability that will delay the engineer assessments and slow everything up. I guess arguing (and more importantly winning) takes time.

I have no choice but to wait and see.

 

In other news Avis are taking back the Rapid at the end of the week as "i was never supposed to have been given it as it is deemed end of life".

With just 10,000 miles on the clock that caught me by surprise but hopefully i'll get another newer one come Friday as i'm really growing to it.

Still struggling with the size/length of the boot though.

I backed up to my garage tonight to unload my new (now pointless tyres) and though "yup that'll be close enough" i was about 4 feet away! :D

Parking sensors are a must on a car the rapids size IMO.

Hopefully they give you a 105bhp to have a play with.

Hopefully you've taken out legal cover so leave it to them to fight it out.

As for stripping parts, anything declared must be on there as that's what their price will include. If anything is missing that should be there, or clearly wasn't there at impact this may void any payout and be classed as fraud.

I'm not sure at what point they are deemed to have taken ownership. From logging the call springs to mind.

Cliff, you worry too much, I have had a few prangs it comes with the high mileage I do, all you need to do is wait now, your account has gone in, the other person has also submitted an account of what happened.

 Insurance companies will now discuss amongst themselves and then you will be told, her fault, your fault, 50/50 who knows, whatever will be, will be.

 You can guarantee your premium will increase because that is what happens, even if it is deemed not to be your fault your premium will go up.

 

 

 Just enjoy thrashing the hire car (because that is what they are for) and worry not, nobody was hurt.

Looking at the pictures, I would suggest that the junction exit is not wide enough to be considered as a 'filter lane', it is more of a visibility splay.

IMHO, you are in the right. If she is disrupting the claim on the basis that you were on the hatched lines, then she must have had clear visibility of you. In which case, why did she fail to give way to you as the law requires. Using, or crossing unbroken lines is not illegal in itself.

Having said that , one thing I had hammered in to me on my advanced bike training was "one in, one out" - in other words, if the car in front turns in, and there is a car waiting to exit, assume it WILL pull out and avoid ' overtaking' at junctions. Not looking to preach, but it might be useful to some.

I hope you get it all sorted quickly.

Word of advise. As I used to work in the accident repair game.

NEVER leave them too it. ALWAYS keep on there case and always protest your innocence.

At the end of the day these people get paid 12k a year and don't give a ****.

Also if she works in insurance she has access to the file (If she insured her car through her company) you don't have access.

With regards to the car and the mods, even if they are all declared and valued they will probably ignore that and give you slightly better than market value. If at all. If it were me personally I would be taking anything of value off the car and replacing with oem items so it's complete.

Not sure if it's an ominous sign but having not heard anything from any potential assessing engineer or repairing garage yet I called the claims people to chase up.

 

Turns out that they hadn't selected the repair/replace option on their system so all they'd done, and all they were planning on doing, was hire me a car!

Told you dude. And I would avoid letting it go into a garage if it stays on your drive you are in control of the process.

Reason why your in a hire car so soon as well is because they want to capture the job and start ranking up the charges. This way they are in control of the situation and you don't run off to a third party agent.... Which personally I prefer doing if I'm in the situation as they work for you and they work pretty damn quick.
