Always useful to hear things from the other side of the fence.

 

I am more than aware that internet postings can land you in hot water if done incorrectly; and it has already been suggested by those close to home (ok she shares my bed) that my involvement in the forum and willingness to share proceedings with the world in this thread may count against me.

However as far as i am concerned in this incident I've done nothing wrong and have reported the events and my opinions on them entirely honestly.

Fair enough. But what i was suggesting is not 'perverting the course of justice'. There wasnt any lies in there, but some things just werent mentioned.

I was however assuming the OP hadnt submitted his record of events already.

All i was suggesting was that not mentionin the chevrons may help him in his case. If they have suspicions and ask specifically, thats fair enough, but why mention something which could have them have second thoughts about whos at fault, when its clearly the other driver. Keep it simple, but never lie.

Just read this thread from start to finish. Sorry to see the demise of your lovely Fabia. I'm glad you weren't hurt and I hope you find a comfortable outcome. I'll be keeping an eye on this thread.

Steady on old chap, I wasn't suggesting anything, just that it can be foolish and short-sighted to discuss certain things on forums, if you read what I put.

Don't forget that both parties to a collision can be interviewed, or a statement obtained from both parties too.

Thankfully it was only within the last 10 years that this reared its head, as investigations can be complicated enough already.

I always thought serious RTC's were often the easiest to deal with, as you could employ AIM, which removes guesswork and supposition in most cases, although please don't read into that I or we didn't have sympathy and empathy for the innocent parties involved.

If you can get arrested for sending certain tweets i'm sure as hell posting something on a forum can be used in an insurance case.

 

However as said i've done nothing wrong and all details posted here by me have been honest and accurate or otherwise just my opinion (which very rarely counts for anything!! :D)

Dont worry about it at all mate. Youll be fine.

Just hope it doesnt take too long :).

When i had a smash 2 years ago, even though the driver denied it being his fault, his insurance company took the blame for him.

Hi, sorry to hear about your loss but I'm very glad you weren't hurt. Shame she didn't sustain something very painful ( but not too serious) though, it's cretins like her that get people killed and keep our premiums sky high too. It's obvious she was not paying enough attention.

I totally agree with Otaylor38 comments though, that's the main reason for my post, his comments make total sense.

They are still arguing about liability but at least i will have the cash to go buy a new car

I don't think its a gender thing i think it's more likely a working-for-an-insurance-company thing.

That said even without that I can't see there are many cut and dry cases where liabilty isn't argued in the modern world (rear end shunts excepted)

Ahhhh the ten million dollar question.

Absolutely no idea as yet.

Almost bought an 06 plate Leon 140bhp Reference with the BTCC kit but it sold before I could get there.

Maybe another Fabia.

More likely a cheaper a virtually identical Ibiza Sport/FR.

Maybe something bigger Leon, mk2 Octavia, mk5 Golf GT ready for a family.

Or maybe something cheap and relatively cheerful to batter around in Saxo VTR, 106 gti

Or maybe go crazy. There's a lovely looking S2000 in a garage I pass everyday.

Yes John I am aware that there are Fabias out there for sale thank you :)

 

If I was going to go down the Fabia route though I reckon i'd struggle with a standard one meaning I should have kept all the mods off the red car to transfer across.

In all honesty if i do go Fabia again i'll be buying an already modded one to save me the hassle :thumbup:

 

I'm kind of looking at me priorities though.

Do i need a "performance car" when 99% of my driving is commuting in traffic?

I could buy a Yaris and do the journey just as well (it'd have to be T-Sport one though obviously :D)

Somehow i think we've convinced ourselves we need to buy a mk5 Golf GT and "something" for me to run around in.

 

Now i'm off to PM T-Spark about buying his (Jonny5ives old) 200bhp Hybrid Fabia ;)

I was on a round about once and got hit by an ambulance in the rear quater (didn't have blues and twos on) after it pulled on. Anyway I got a lovely letter from their insurers at first saying it was my fault, they expect me to accept full liability, so I sent them an arsey letter back saying they misspelt my name etc. and for future correspondence they should contact my solicitor or my insurance company direct.

 

Needless to say they eventually accepted full liability.....

Mr Pasty, I do recommend the Leons.

 

The wifes is almost as much fun to thrash as the Fabia and its standard :)

 

I was impressed but then I went in with low expectations.

The phat (how street am i?) BTCC bodykit hiding "just" 140bhp.

Not sure if it was the relative non-exposure to performance in my time in the big brown bus but it felt proper rapid.

Suspension on the BTCC version was rock solid or the rubber band profile tyres made it feel so but it did feel pretty quick,

 

It certainly felt better than the RenaultSport Megane 175 I drove earlier in the day.

 

We shall see the options are (mind bogglingly) endless

I can see the logic in all sorts of cars Pasty, but I'd be lying if I didn't say I'd like to see you back in a Skoda.

Really feel for you, must be heart breaking to see a motor on which you have lavished so much care written off.

Leon suspension setup isn't good IMO. Seems under-damped and oversprung to me! Something like an FR PD170 wasn't very pleasant over typical British road surfaces.

Firstly, I've only just seen this so sorry about the car, no one likes to see another members pride and joy damaged.

 

So the next bit, why and how do people do this clearly she went into the side of you, are are on the main road regardless of if you flash or even signalled she is at fault end of story. This was excactly what my ex was told be the police when she pulled out on someone that signalled to turn off but carried on.

 

As for people trying to get out of being at fault after castle combe 2010 I parked in the service station on the M4. When I came back to the car I heard and saw a ford reverse into the back on my parked and non moving car. Apart from the fact she tried to do a runner (let me tell you I didn't know I could run that fast), she said at the time (caught on video by my brother) oh its my fault I'm so sorry.

 

She gave the details and off she went. Not only was the address a fake one (my insurance tracked her down by the vehicle) but she then said I reversed into her and drove off. Saying it was my fault.

 

Lucky I had a witness that offered me her details at the scene. After discuss this and the fact I said I had recorded evidence of her stating she was at fault, blame went back to her.

 

People try it on, deal in facts and keep to them and don't feel bullied (which I'm sure you wont) into accepting 50/50.

As soon as she dropped the "I work at an insurance company" bombshell I was expecting a fight but (as every single person i've spoken to seems to concur) i can't see any fault on my part.

The worrying thing is that it's been almost a month and as yet her insruance refuse to back down and accept it; and possibly even more worryingly, my insurance haven't been able to convince them. 

 

Or is this just how insurance claims work?
The back & forth between my guys and her guys which should be one phone call ("she drove into him" "yes she did. have the money") actually takes weeks of non-activity and only moves when i ring up and prompt them?

so prompted by my own questions i've called my claims people again and pushed for more details about why exactly this hasn't been settled yet.

 

There has been issues with sending my accident report and the google streetview photo of the scene to her insurers which hasn't helped, neither does the complete lack of witnesses to corroborate any stories.

 

Main problem though is that apparently in her version of events I crashed into the front of her car with the side of mine (quite a task in itself!!) after making a overtake of a stationery vehicle which had stopped to let her out of the side road.

 

This completely ignores the slip road said stationery vehicle - which wasn't stationery - was in at the time and the fact that said stationery vehicle was mostly not in my lane of traffic when i "overtook" it - a more accurate description would be "drove past"

 

Ah well hopefully once the pictures are received it'll clear things up and all shall be settled.

and to be honest i've got 10 months until my renewal and lord help me if it isn't settled by then!!
