Its just insurance companies, my accident is coming up to a year now and 3 months since i was given the option to go to court.

and last time i asked they still hadnt got the other parties statement it was just the other parties inaurance that refused to admit fault.

It's a good way of keeping premiums up, even those not at fault get an increase come renewal time that way.

You have to wonder if they do it on purpose.

Overall, they all gain. We lose.

My Dad had a driver change lanes in front of him on a large Multi lane round a bout and clip his front left corner, spinning the offending driver round and crumpling my dads bumper and bonnet. At the scene the driver admitted fault as he didn't see my dad in his wing mirror. Who'd have guessed he changed his story and he started to say it was Dads fault. Long story short, after 10 months, diagrams and google map images showing the scene etc. the other drivers insurance company would not back down and wanted to go to court. After legal teams being instructed (all by the insurance company) it Got all the way to the court date (neither driver was instructed to attend) the other drivers insurance company representatives didn't even turn up. Complete waste of time and money for both insurance companies. Blame was of course decided in favour of my Dad.

I had someone hit my motorbike many years back. I was going straight on at an island and he pulled out from the left and clipped my left side before leaving the scene. When the police interviewed him he claimed he was stationary, waiting to pull out when I rode into him, sideways.

firstly, glad you are ok cliff, I've been there.. accident caused by another party who then subsequently claimed it wasn't their fault, so I sympathise with you on that. don't read too much into it though, its standard practice for insurance companies to deny liability and make it your fault for being on that road at that time..

This gets less and less fun

 

After getting agreement on a without prejudice payment from the third party last Tuesday (they pay the settlement to get me out of the hire car and minimise charges) i've been phoned every single day by my claims people asking if i've had the cheque.

i'm not sure how many time it is necessary to say "yes i know. yes i'll let you know when it arrives" but apparently 7 wasn't enough.

 

So last weekend we planned ahead and took the big brown buss to Cornwall for the weekend to sort some wedding stuff and see family.

At the same time collecting and returning to Cheltenham with the inlaws caddy van for me to use in the interim while we search for a replacement vehicle.

 

clever huh?

 

so the cheque arrived Tuesday, i phoned them yesterday (postie is late around these parts and the claims people are shut when i get home from work) so they offered me a week more with the hire car but i was very generous and said "no don't worry i've got another vehicle sorted collect as soon as you want"

 

Thursday morning sometime between 9am and 1pm?

i'll be at work

how about between 1pm and 6pm? 

funnily enough i'll still be at work.

well you'll need to take a half day

will i really? can you be anymore specific with the time?

ok fine Thursday mornign it is.

 

I phoned Avis direct and asked that they could do it as early as possible like 9am so i didn't have to take a day off work.

yes sir no problem.

 

what time did they arrive? 1:20

nice one, failure on promises from both companies.

 

watched the nice eastern european gentleman head to the car and then for some rason not get in and drive off.but instead get his phone out and start taking pictures.

Everything alright?

here's hoping that Avis report it ti Quindell and Quindell do the only common sense thing and get their insurance to poayout and add it to the list of costs that need to be recovered from the third party. Otherwise i shall not be happy!

 

so i'm already fuming but at least i can now head to the office.

incredibly dull headlights

I'd have gone absolutely mental. I'd have taken the keys for the hire car back into the house and stayed inside until Avis sent the branch manger to check the windscreen and agree there was no damage.

This gets less and less fun

On the Aviva thing - that has happened to my mum following an accident where her car was written off by a lorry last year. She has complained about it after being harassed for months. She got this letter back:

It's featured on the BBC News website this morning, Aviva blame some rogue employees for passing details to 3rd party companies, and will look at claims for compensation on an individual basis....

...and as expected today a bundle of joy has dropped through my letterbox in the form of incident report forms relating to a chip/crack in the windscreen of the hire car.

Half a dozen page of drivers details, third party details, accident report diagrams, road position diagrams, road conditions, factors of note, vehicle damage diagrams etc etc.

Truly unbelievable. It's gunna be a long hard fight.

I'm gunna refuse to sort anything out until they sort out the liability of my claim out.

Wonder if that will spark them into action.

 

I've also had the mother of all fights to try and sort out my insurance for the new car.

Compare the market says a standard Fabia should be £180

Compare the market says that the new car should be £270

fine so far and to be expected.

but my policy on the modified car was £280 back in December so we should be about right.

nope not a freaking chance.

 

that'll be an extra £180 to change car sir.

um why?

well it's gone up insurance groups. 

yes but it's no longer a modified car

but it's on a modified policy

oh we can;t change that mid term.

ok so cancel it refund me and i'll go elsewhere

ok but we won't refund you until your outstanding claim is settled

but your the ones dragging your heels on that

well that'll be the claims team i can put you through if you want.

no don;t bother.

ok so how much will the refund be - £280 over 12 months = £23.33 per month

taken out at the end of December, so 2 and a bit months call it 3 so £280  minus (£23.33 x 3) = £70 = £210 refund.

uh no sir as you've had the policy up to 3 months the refund is 50% of the premium.

um right ok them so that's £135

well yes but they your underwriter has a cancellation fee of £20

so £115?

then we have a cancellation fee of £25

so £90?

then we have a commission to take out of the refund which is another £22

so my refund is £68?!

yes sir that's correct

from a £270 policy which operated for 2 months i get £70 back?

yes

so £100 a month?

yes

but you won't give me that £70 until the claim is closed.

no

ok bye

 

and then i had to go for a long walk!!

oh and to cap is all i did call the claims department to see if there had been any movement and was told no they are still arguing so we have now requested the third parties accident reports.

 

now requested? NOW? ONLY NOW?!

 

8 weeks after the incident you've only now thought to ask for the official reports from the third party?!

It's a rob Peter to pay Paul situation to move forward now.

Even though i can move to a cheaper standard policy through the meekat site I don't get enough of a refund back to make it worthwhile.

i can cancel a policy to avoid spending an extra £180

only for them to give me £70 and me to have to go and spend £270.

I've never been so annoyed.

 

Also because of said slow prolonged open claim any other insurer i did speak to would add an extra £100 to the policy because of it - which may (or may not) be refunded should the open claim be settled in my favour.

 

I have come to the conclusion that insurance is absolutely fine until you actually have to use it; then it becomes more painful than a cactus in the rectum.

That's ridiculous! Hope you get it all sorted!

To be honest I've got no choice but to swallow the extra on the premium.

I did kick off and they eventually agreed to reduce the extra fee from £180 to £100.

 

if i cancel it to move elsewhere, i get £70, if i don't move the policy to a new car by the end of the month they cancel it anyway and I get £70

 

Pay up stomach it until December then get the hell out of there at renewal time, assuming they've got off their arses and actually settled the liability on the claim by then!

Holy rip off Batman. I know the insurance sector gets a bad reputation, but boy do they deserve it in this case. just remind me in extra big letters who it is who insures you, just so we can all remind ourselves of who we will never use in the future (The biggest bold font you can find and in red, would be good for me :)

Did you say your insurance was with Adrian Flux Mr. Pasty?

 

I'm sure they're all as bad as each other, but maybe it's worth pointing them in the direction of this thread if it's not resolved very soon?

 

I hope I never have to claim on car insurance. Claims with my professional insurance have always been dealt with quickly and courteously. Fastest resolution was 24hours. I can't see why other insurance can't work in the same way.
