It is possibly to sell an unroadworthy car if you sell it as unroadworthy, 

but if you have a car in need of repair and sell it on, you need to be telling the buyer it requires repair and work, and they buy on that terms,

that is not Illegal.

That is how many even on this forum might sell or buy cars.

 

Often a bargain is a bargain because work is required to make a car roadworthy.

Private sellers and Traders often sell cars on when they buy one that they find requires too much work.

If that is illegal, then many people are now well stuffed.

So was the damage done prior to the MoT, and then sold on to you

If so it might be worth reporting the MoT station to VOSA, as they clealy seem incapable of spotting fundamental fail issues

It's a criminal offence to sell an unroadworthy car this is correct, however because it's a county court case this matter cannot be dealt with at county court.

Vehicle was purchased April 2014, covered around 200 miles in it. No work has been done with it since I've owned it.

Has the car been sitting around for the past 11 months.

When did it fail the MOT you put it in for?

 

Have you had a Specialist Motor Engineers done on the car, or just the MOT Failure & then the Quote for the repair?

Failed the MOT in June 2014 since that date I contacted the court and started a money claim, but I'm sure as some of you are aware these things take time with the courts.

I had a DEKRA vehicle check done on the vehicle which returned the vehicle as 'unsatisfactory', it's now up to the judge.

Can i be cheeky and ask what you paid **** Turpin for this car,

 and how long had they been the Registered Keeper of the car?

 

Where they the Keeper on the V5 when you bought the car?

Course I paid 6100 with 39000 on the clock, a fair price when I researched it, not the cheapest but not the most expensive example available at the time. He had been the keeper for over 2 years and yes, he was the registered keeper at the address I viewed the vehicle at

What date was the original MoT given with the vehicle, and has the seller confirmed whether or not the car was damaged after that MoT?

VOSA would have been worth dealing with right back last June.    

They could have carried out an Inspection.

 

It is always said that a MOT is on the day and what is presented.

So 6 months and anything can happen.

Mot was dated August 2014. He's kept up with his it was sold as seen line

Things like screws missing on the bumper, it's not aligned correctly

What are the parts that are getting the cars repair quote to £6,000 ?  Is it Suspension Parts from Accident Damage?

Body Work is a simple repair, if it is not Crumple Zone Damage and the likes.

 

 & what sort of labour charges are being quoted?

So he didn't get it MoT'd immediately prior to sale

So he's obviously keeping quiet about when the damage occurred and jow bad it was

Seems odd he didn't go through insurance, otherwise it sounds as though it would have been a Category whatever write off

Yeah, my own stupid fault not asking for one to be done. Keep your eyes on eBay because it'll be on there after April the 10th

Many cars are not reported as being in Accidents if they are only insured 3rd Party or 3rd Party F&T,

 because the Insurance will not be paying out anyway.

 

Not a good thing,

but thats the way the UK Government & the Insurance Industry allow things to proceed.
