Hi again. Only posting because if I think this and, as said by another, magistrates see it every day, then it doesn't hurt IMO to hear another viewpoint. I am sure you have read your mitigation letter many times over.

It is because you have so much riding on the decision that it makes sense to take a step back and get a professional opinion (in my opnion, and others who have replied also).

This isn't personal by the way one little bit. It's not me (or any of us) that you have to convince. Good luck again that you succeed in persuading those you do.

And the chap attended the hearing with the MD of our company in tow and I think it helped his case. I don't know how some courts react to a non attendance, could be a positive, could be a negative.

I have done quite a bit of research, getting free advice etc. From what I've heard magistrates will tend to read more out the book if you don't attend, your less likely to get either a servere or a light sentence than if you did attend. :o

I suppose it's partly down to luck, every magistrate is different no?

I think it's very much so down to luck. If you get a bad magistrate, or he/she gets out of bed the wrong side that day...

Anyway, what's done is done, I shall find out soon enough...

You can't be banned by post, as a ban is effective immediately.

With me, the "plead guilty by post" was not allowed, as they wanted to ban me... it was only a well prepaired defence that kept me my license!

According to the magistrates guidelines if you travel at up to 30mph over the limit, then you're eligible for a fixed penalty, 3 points and £60 fine. If you go to court then your fine will be increased to include court costs. expect 3 points and £100 fine.

If I was offered a fixed penalty, believe me I would of taken it! I was told by the traffic officer, it'd have to go the court, if I get 3 points and £100 fine, I'll be very happy indeed!

Jason you are right about diesels they dont rev hard and the fabias really do handle the speed well (unfortunately at times)

I second that also, i've only had my license since March this year. And u may all laugh but i find myself getting quite high figures out of my 1.2... so like harry this thread is a real eye opener, going to really cut bak on motorway.

At that speed, yes. It was late at night, and there were NO lights in my rear view, so either he was on sidelights and a long way behind me, or had no lights on at all. Irrellavent really.

I will agree here with Mr chippy!

I was done for 116 on the M6 at the begining of the year I did not see them until they came tearing up behide me..........only turning on the lights once near on my bumper. They had been following me for about abit or so they said in court.

Yes over 100 is a BAN!! :rolleyes:

I think 99.9% of us have sped one time or another, probably half of us speed to an extent pretty much all the time. For the latter, you MUST be prepared to get caught and be punished for it!

Yes you may get away with 33 in a 30, 44 in a 40... 77, in a 70 etc, but even that's not for sure, my grandad got caught doing 33 in a 30 on a sunday afternoon going to his allotment and got 3 points and a £60 fine!! :eek: He's only conviction in over 50 years of motoring!

I remember being driven around by my dad at supersonic speeds when I was younger, you just can't do it now, with all the technology, tactics and dreded cameras around, it's just not possible!

For new drivers, if you value your licence, you just CANNOT risk speeding!

Hope you get off with the lightest sentence etc, but that kinda speed:

From what the police officer (traffic) told me when I got pulled doing 3 digits (just):

* I was aware of my speed ==> i.e. I was paying attention. Plus point

* Conditions were excellent (no wind, rain, dry road, road virtually empty) ==> Helped.

Had conditions been worse, had I been tailgating etc etc I would have had a ban there and then.

* As soon as I spotted the officer involved 'moving' I started to find a safe place to pull of the road with space for him to pull in behind me off the main carriage way. ==> Helped as again, I was paying attention

Also he basically said I was dead lucky - got 3 points, 60 quid. I've put the points in my sig to remind me to enjoy the car and try and avoid going too crazy on public roads ;)

Yesterday I nearly got run off the road by some muppet doing that kinda speed in a 50 mph, speed camera'd, work in progress area on the M3. I hardly ever use that road, but due to M4 problems I went there. The guy involved shot from the sliproad straight across the lanes into the fast lane behind me, and as soon as I spotted him I attempted to shift back into the middle lane (no gaps) - ended up planting it to avoid getting hit from behind. Had there been a speed camera I would have been done at that point.

As for a 1.2 hitting high speeds - hell that Rover 100 did 3 digits on the clock after a (long) time, probably 90 mph tops in reality, but still in high-risk speed range.

These days I tend to enjoy the twisties, not necessarily speeding but just enjoying the bends etc, and sliproads :D

Yeah - I reckon minimum of 6 if you are extremely lucky TBH :(

As I said, I was very lucky and the circumstances were 'right' considering. Had it been a scamera van I would have been in the same situation as you probably, in fairness.

Good luck with the court thing though :thumbup:

I didnt think you could get points AND a ban - just one or the other.

I got caught at 124mph on the A1 - got banned for 42 days, no points and £300 fine - and this was with a letter from my company saying I would lose my job if I was unable to use the car for an extended period of time. It was also a first offence in 14 years of driving.

I wouldnt expect too much leniency for much over 90 these days, and I agree that informing them you were unaware of the speed of your car is not a good idea. Dress smart and eat masses of humble pie, as the previous offence is not going to help you.

As an add-on to my last comment. I spent approx 15 min of a 20min chat in the back of the police car listening to how great the vRS is. The driver had just tried one out to replace his vauxhall (he may have been confused as we were actually in a Volvo). Either may he loved it - but still gave me my NIP :-(

I got done for 60mph in a 30mph zone which is an instant ban offence.

I got 6 points plus a £180 fine for mitigating circumstances and later on realised I should not have been done at all but that is in the past now.

The road was a national limit for the 6 years I had used it then one day it suddenly became a 30 limit. I never saw the sign as only one had been put up and not the normal 2. There was no spped markings in the road for such a drop etc and it was the first day they dropped the limit the thieving, cheating *******s as they put a mobile camara up

Anyway due to the change being that day I was not banned

Later on I was told if I had took a picture of the missing 30mph sign then they could not have done me!!!!!! (only one side of the road had one and it was on the inside of the corner when I turned into the road so never saw it)

Still ****ed off about it to this day as I never speed like that in 30 zones ever

you really need to be represented if it goes to court

my brother in his youth tried to get away and hide down a back street to escape the police after a van saw him racing on a main road, he pulled over, switched his lights off and ducked down inside the car, a kind passer by alerted the van to his whereabouts and he was done for dangerous driving. He thought like yourself that he could handle it on his own until the point where the prosicution said they would like to set bail for Mr F*******. They dicided it wouldnt be necessary as he had turned up this time and let him go but realising the anormity of the offence he took the appropriate steps and got a solicitor specialising in traffic offences, solicitor got the offence reduced to driving without due care and attention, no sentance and no ban 6 points, very very lucky
