  • Advertised as the best handling car........a drivers car even. Yet when tested it failed and BMW will not pay out.   Now personally I'm on the fence on this one and can see both sides of the view. B

  • Agreed Richard.   They are clearly trying to have it both ways.   Well in that case they need to change their advertising:   BMW: The Ultimate Driving Machine*       *Definition of driving i

  • Just read on the PH thread that BMW have now agreed that the trackday was not competitive so they are paying his claim in full. Great result!!!! I bet he is one relived chappy...

where do manufacturers get off though? seriously. the RS in my cars name stands for "rally sport" ....

I have just been reading this weeks auto express.... they have taken every car they tested on the track...

two of them , the corsa VXR, and mazda MX5 both have things specifically designed, and I quote "for when owners want to go on the track" the bigger brake option for the VXR,options from the "nurburgring version"  the ability to completely switch off the ESP on the MX5... "for more fun on the track"

these things are being sold to be used on race tracks, according to the features fitted by the manufacturers, they cannot sell these cars with features for "taking it on the track" then refuse to pay if it brakes!

the vauxhall thing with the ring makes me laugh... on public days the ring is "an extention of the German highway" the people that live there buy year tickets, and actually use it to drive from their houses into nurburg.... I passed white van man on it last year ... they can't say you were racing! I was certainly driving slower than on the unrestricted autobahn at times....

where do they draw the line.... are they going to say some of us have been "racing" on the public highway, (140+mph on the autobahn?) and then refuse to pay ?

The manufacturers clearly haven't caught up with the times.

Like you said, more and more people are venturing onto track sessions with their pride and joys.

Manufacturers are cashing in on this by offering hot versions and options to make it more fun for owners.

Yet they are not willing to cash out when the warranty claims come through...

I reckon it will change, but may end up in having to pay extra for a 'Track day Warranty'

we had the same with vauxhall a few years back, Refused a warranty claim due to car being used on Nurburgring, they even sent a picture on email of it in a TF session.

After we had stopped laughing, especially with the comment on their refusal that "trackdays exclude the car from warranty claims" My brother then promptly put up some posts on VXRonline to tell them that if they were booked on the forthcoming vauxhall organised VXR trackday their warranty was voided.   20 minutes later and a very worried UK  Director of  VXR brand from Vauxhall was on the phone to my brother asking him to withdraw the thread and that it had all been a mix up.  As a gesture of good will they gave him a free trackday......lol

This is also the major reason most people take their numberplates off on trackdays.

Also BMW car club ( backed and advertised by BMW) offer BMW only trackdays subsidised by BMW.  So surprised if it's just due to Trackday use, BMW are not that silly and know owners do trackdays in their cars, hell they even offer driver training themselves on track.  So i would suspect more likely that theres Data there to suggest over rev or somethign similar ( assuming its a manual)

It was an Auto.

Be careful, Santa Pod has an element of competitiveness in that the run is timed and the cars are often run against each other.

Some years back I was told by the owner of a M BMW that he was only allowed to use the launch control 5 times, any more than that and the warranty was void.

Good job my Mk1 fabia didn't need any warranty work doing.

I found footage of it on a DVD of it being spanked round Anglesey by a bunch of journalists!!

It was a former Skoda UK Press Car.

OK, so that is BMW's warranty put under the spotlight. Now what do Skoda mean by motor sports activities in their warranty?

Exclusions...

Damage or defects caused by improper use of the vehicle, neglect, or use of the vehicle for motor sports activities.

I suppose the warranty on the vRS Fabia in THAT episode of TG would be void also?

Along with every other car that's done the hot lap?

The track day is largely irrelevant.

Manufacturers and third party warranty companies will always try to wriggle out of a warranty claim. It's business after all.

The vast majority of people accept their verdict and pay up. The manufacturer saves thousands of pounds.

The minority dig their heels in, the manufacturers pay out.

As more genuine claims are rejected than those that are paid out they always win.

^^^ true.

Wouldnt be surprised if it was anything other than an M BMW.

I mean. Its a proper performance car, if it cant handle a few laps, its boarder line not fit for purpose haha

its always about money, (everything... dont even get me started on world events, wars ect)  I got booked for parking when I had forgotten to change the clock in my car  (daylight saving) , so was booked and charged by the council for staying over an hour... which I didn't (and the parking attendent knew I didnt, but booked me anyway to meet targets, because the clock in my car showed I had been over an hour, because I got the time wrong)

I appealed of course, explained that they cannot prosecute me for something i am innocent of (stayed less than an hour) , and asked them to provide CCTV footage of my movements.......

of course they simply cancelled the ticket..... BUT bet they have made a lot of money  with people who wouldnt fight........

"sings 'rage against the machine' in his head.........."

Urgh not parking.

Its another story for another thread.

But my grandad parked round the corner from the machine he bought the ticket from.

Nope. That space requires a different machine, you arent covered, here's a parking fine.

Cheers pal.

****ers.

Anyway. Back to the BMW... Haha

So a BMW warranty is voided the moment a tech takes it out for a drive then :D

Mad isnt it.

Drive it like you stole in on the road

But tootle round a track. Nah. Not covered mate.

True and ridiculous

Quite interesting to read some people's opinions, very blinkered in my opinion. I guess if you click the link again you'll notice BMW honoured the claim.

Post #42 in this thread would tell you as well if you are not linking to PH .

Topic title updated to reflect the good news.

Good on BMW for doing the right thing. Guess they are not necessarily the cold-hearted evil empire we thought they might be haha!

This is exactly the kind of statement that gets me worried about taking any kind of performance car into a dealership or garage for work! ;-)

I always imagine the "testdrive" bordering on a race/rally/Motorsport event lol.

On one of the BMW forums last year a guy took his M135i into his dealer for some work. Two techs took the car out and were ragging it somewhat. Their mistake was not noticing or sufficiently disabling the hardwired dashcam..... The owner posted the footage online and it didn't make for comfortable viewing. He then complained to the dealership and both techs were fired on the spot.

There is no doubt that a lot of them do absolutely hammer the customers cars, there are a few who drive them more sensibly but they're in the minority. Most of them don't know what a Dashcam is let alone how to disable one :giggle:

I never wash mine... does that count as "neglect" ?

Regarding the body warranty, almost certainly. I'd doubt that it invalidates any warranty on suspension, mechanicals or electrics though.
