I'm sure the online response had nothing to do with it, they are just kindly souls who changed their minds. :D

Haha fair point, but I guess however it came about at least they did the decent thing in the end.

Makes you wonder if it was a very junior administrator who rejected the claim and when the potential bad-PR came to light the senior management stepped in to sort it sharpish.

BMW back on my next car list.......well maybe!!

Its not just manufacturers that exclude track day use , many of the tuners who owners trust to pick up the bill if their engine lets go after mapping have clear exclusions for track day use

 Now , OT I know, but if you could get Monkey and Sutters to present a car show (and not that tit Wilson, bimbo, Je(i)zzer et al), it would be well worth watching.

Tuners with T&Cs? Like who? I think the agreement is usually At (your) Risk.

Is the Exclusion there from Superchips including 'Trackdays'  or am i reading that T&C wrong ?

It's not worth the paper it's printed on. ;) Note that it requires the manufacturer's warranty to remain in force, and you could well have just invalidated that by getting the car chipped!

Wonder what BMW's stance would be if the engine in that popped and you whipped out the drifting shots from autocar, whatcar etc.... :wonder:

Mate the Chris Harris car was definitely sold on to a punter, fairly recently. I suspect that car had had a very hard life lol!

Given that BMW have now paid out this claim I think they have set out clear precedent that trackday use is fine without any need to worry about warranty being invalidated. After all as you say - are they advertising all the press cars that have been on track as ''no warranty"? They wouldn't dream of it. :-)

Suggest that this is an issue that BMW have known about for more than ten years and therefore shouldn't have dragged their heels on.

 

 


Finally got a result in my dispute with BMW. Having piled the pressure on with press and public opinion - I think BMW finally realised this was going to look REALLY bad for them. 

My lawyer got a letter from the Managing Director of BMW (GB) today... the important bits below: 

"In an effort to address the main issue of your client's complaint, I would agree that the attendance of the track event by your client as described should not be likened to "racing, rallying or a competitive sport", where even a high performance road going vehicle such as an M3 will require modification to avoid extreme wear and/or failure of engine, suspension or associated components. I would deem our refusal to cover the costs of this repair under the terms of our warranty unacceptable. I will therefore ensure that Mr Carter receives full reimbursement for the repairs carried out. I will also ensure that the wording in our warranty documentation is updated to avoid any further ambiguity."

Yep, the "getcarter" precedent was very useful to the chap with the broken M235i! I believe he made very specific reference to it in his dealings with them. To be fair they didn't drag it out too long, but should never have turned the claim down in the first place :-)

A good reminder to anyone posting things online. If you don't want it seen by even one person don't post it. I've heard of a few warranties being voided because of Santa Pod and other timed events. Not because the owner said but because the dealer is on the forum and saw the pictures.
