The Five-O motoring forums, had somebody who was caught this way and the learner recieved the points anf fine not the instructor who simply had to say who was driving.

Its always been a muddy issue as the instructor/person in the passanger seat is technically in charge of the vehicle and hence should get the points. Personally I dont want to put it to the test!

And in South Africa , and other parts where they talk Boer ( won't bore you with that ) --a brai (pronounced (bri, can't spell the africaans for the full title) is a good excuse to burn meat over an open fire and drink lager/ beer whatever.( to excess )

Just thought that might put a better face on things.
