Well I've decided to totally walk away from all this and forget about the Sport and the Green Rapid. Apparently they couldn't do me a deal anyway as its a high specced car.

So the 3 way argument is on between the dealers,VWFS and SUK to who's going to pay the £3500 negative equity as I've bluntly told them I'm not paying a penny more. The guy at VWFS is just going round in circles he's useless.

Anyway I've still got the Citigo so I'm not bothered.

So the story continues for now.

Have they settled the finance or is the agreement still open against your name?

Need to be careful there mate. Even though they are disputing it its in your name and your credit history that takes a beating if it is not settled satisfactorily.

I'd ask the dealer to settle the finance whilst the dispute is taking place.

Doesn't whoever provides the finance have to stand the loss, then claim it back off via insurance, or something like that. Surely it's similar to banks and them backing you up with dodgy credit card purchases, they provided the credit.

You've bought an item that was defective, therefore you have returned it. It was not fit for purpose as per the sales of goods act therefore you should not pay a penny more and should have what you paid refunded.

Doesn't matter how big or small the item is you agreed a price. You've paid some towards that price, found out about the issues so sent it back. Why should you have to fork out a penny more for it? I'd be mentioning solicitors at this point.

Are you not getting back what you've already paid? Surely that should be the case?

Totally agree with all of the above.

All I'm saying is you need to get that finance agreement settled sharpish as the guy at VWFS who's job it is to action defaults may not necessarily know the full story.

I also agree with Natailies comment about being refunded what you have already paid...

The way I see it is that you have paid your monthlys whilst you had use of the car. The vehicle is defective and is owned by VWFS therefore they are in breach of contract as they are not supplying you with a vehicle that is fit for purpose. Things do fail but they have to be rectified within a reasonable time and without significant inconvenience to you.

VWFS cannot make you pay the negative equity as they have caused this by failing to provide you with a product which is of satisfactory quality.

VWFS need to take this up with the dealer as their contract is with the dealer not SUK. Either way you have the right to walk away as you have paid your part up until it failed and beyond.

Dont think you can get back what you paid since they provided another vehicle when yours was no on the road , the negative equity should be covered though , you should be able to hand the car back , hand back the loaner and stop paying

Thanks guys for the replies.

The car is still at the dealers after 6 weeks now. I've handed back the documents for it and removed my things. They now have the loan car back too.

VWFS said they will refund me for the time it has spent at the dealers but have not mentioned I need to pay the negative equity in it yet.

I should hear something on Monday.

I'm sure it'll be up for sale as a low mileage ex demo before long...

Probably, doubt it will even get fixed the dealer doesn't sound too competent!

The plan is that the dealer is putting it back in stock to be sold.

The case has now been passed to Skoda UK rejection team. There's an argument at the moment as to the cars value ref the neg equity remaining and who's paying it (not me). The dealer are saying that they've put in hundreds of hours under warranty trying to sort this problem to which they don't get paid for. But anyway not my problem. They can argue it out.

Also car reg no: HF64 LXZ it is [emoji6][emoji6]

It does yes. I'm gutted by the whole experience. I was offered a brand new like for like today and carry on where I left off but I refused. I just want out now I've had enough [emoji17]

They're still arguing over the value at present but I've warned them to end all this before the 6th March as next payment is due then and I'm not paying it and I want my compensation ASAP. VWFS are still trying to talk me into keeping etc like they would do but I'm not budging. I told them to take the argument up with Skoda rejection team instead [emoji16]

Whilst in the dealer today to book the Citigos service I was told that on March 16th some top men are coming from Skoda UK to look at the Rapid as this is an isolated case (apparently).

It makes no difference to me as its out of my ownership but SUK and VWFS are still arguing over who's going to cough up the £3.5K neg equity [emoji16]

SUK customer satisfaction team have said I'm entitled to the rejection and I'm out of the equation [emoji106]

Also my DD is cancelled with the bank which I doubt they'll like but I have warned them many times about it.

Surely you're going to have to take them to court soon if they dont get on with it.  How are you supposed to buy a replacement vehicle at this rate?

 

Maybe a gentle threat of impending legal acion will chivvy them along.

Yes last letter a few days ago to them was a threatening legal action one [emoji106]

Trouble is the guy who's dealing with the case is very non committal. I've given up calling them now. I'm doing it all in writing instead.

Maybe but the law is on my side under the Sale of Goods Act. I'm well within the time restraints of rejection so they can't do anything.

Update on this.

The dealer has had this now for 79 days [emoji15] and still no fix!!

SUK inspected it last week and he reckons they all do it but said there's something not quite right. What a pr!ck [emoji35]

So due to conflicting feelings in this there was an independent inspection on it today and this is supposed to be the final answer so VWFS reckon then hopefully all being well pending his answer I can be set free from this thing.

I've also had to bring in the Financial Ombudsman to help me sort this out as VWFS collection dept have been on to me due to me cancelling all payments after February. I've referred them to Customer Satisfaction who are dealing with my case. I really hope no one has to go through this type of thing with them as they purely just cover up and cover each other's backs and don't give a flying F about us poor customers.

Oh dear.

It's just had an independent inspection done. He drove it for 40 miles apparently and couldn't replicate the fault [emoji57]

I suppose VW think they've won now. No doubt they'll contact me soon. Me and the dealer are gutted. Don't know what to do next.
