Volkswagen Sued by West Virginia Over Clean Diesel Claims

West Virginia may be the first U.S. state to sue Volkswagen AG for deceiving car buyers after the Environmental Protection Agency said last month that the company had installed software to hide that its diesel engines exceeded pollution standards.  Attorney General Patrick Morrisey seeks restitution for Volkswagen customers, who he says paid as much as $6,855 extra for cars with the clean diesel engines, plus $5,000 in civil penalties per violation of West Virginia’s consumer protection law.  There are about 2,684 Volkswagen vehicles registered in the state that have diesel engines with the software to cheat emission tests, according to the complaint filed Friday in Kanawha County Circuit Court.  While diesel-engine vehicles with the so-called defeat device complied with U.S. and California standards in tests, the software switched off emissions controls on the road to improve performance, generating pollution at levels as much as 40 times the limit. The EPA estimates that 482,000 of the 11 million vehicles made with the device were sold in the U.S.  Volkswagen faces a criminal probe in Germany and also by the U.S. Justice Department, as well as a joint investigation by at least 45 states under environmental and consumer-protection laws. California has since started its own investigation, too.  More than 229 lawsuits -- with claims for billions of dollars -- have been filed as class actions in federal courts in at least 37 U.S. states. The automaker is accused by car owners of inducing them to pay more for their vehicles.  Volkswagen spokeswoman Jeannine Ginivan didn’t immediately respond to an e-mail after regular business hours Monday seeking comment on West Virginia’s lawsuit.  “West Virginia consumers responded to Volkswagen’s advertising by purchasing TDI clean diesel models, expecting that their vehicles would be environmentally friendly, fuel efficient, and high performance as advertised,” Morrisey said Monday in a statement. “Volkswagen will not be able to comply with the EPA order to make the affected vehicles comply with emissions standards without substantially degrading their performance and fuel efficiency to a level below what was advertised.”  The Texas county that includes Houston was the first government agency to sue the German carmaker. Harris County is seeking $100 million for excess pollution from the vehicles.  The case is Morrisey v. Volkswagen of America Inc., 15-C-1833, Kanawha County, West Virginia, Circuit Court.

Considering the amount of coal West Virginia produces, their action is ironic, if not hypocritical!

With the greatest respect that is very very relevant to the OP that started this thread, and what is happening in North America,

 

but as for the United Kingdom and Europe the relevance is that it might leave Volkswagen Skint.

Or in a seriously desperate state.

 

The thing is that over the past 2 weeks, Volkswagen in Europe are still taking the Pith. stretching it out, 

still playing with Customers and owners of vehicles they produced and sold,

and taking the Mock (spotten) out of Customers by using the Media and the Motoring Media.

The German Government and other Countries Governments are allowing the VWG to stretch it out,

but let's see what happens when we get to the 7th October.

 

They the 'Volkswagen Board' knew a long time ago that this was going to come out and had time to investigate if Volkswagen needed to Investigate what they already knew they were up to.

 

It is just more playing for time, and management reorganisation is just like moving Sunbeds on the Titanic.

 

VW could make a clear announcement of all the vehicles they sold that are not affected in anyway 

by cheating of Emission Tests at the time of EU Testing and when Type Approval was being applied for.

Diesels and Petrols.

They very likely can not do that, because that is a huge can of worms.

Just had a call from Skoda CS - my 2014 2.0 TDI is definitely not affected - it's a Euro 5 CKFC engine.

Do you have any evidence that the 'Volkswagen Board' actually knew a long time ago that "defeat devices" were fitted to their diesel engined vehicles or is this just another of your conspiracy theories?

 

If there is actual physical evidence that they knew, i.e. Memos, Minutes, emails, etc. I am quite sure that Board Members will be prosecuted in Germany and probably in the US which now has lots of unused space in their delightful Cuban detention facility . . . although the Americans don't really need any evidence against Foreigners ;)

Hi All,

Put my VIN number into the Skoda recall link above and it came up with no recall listed.

Didn't believe it so rang my local Skoda garage in Yeovil who service my Yeti and sure enough based on my registration number I'm on the recall list and will expect hear from Skoda in the next month.

They couldn't tell me what the recall involves as they don't know themselves yet.

I hope it wont effect the bhp of my 170?

 

What surprises me is how VW managed to keep the 'cheat' quiet for so long when lots of people in the ECU programming section must have known with management consent.

Why cant VW make better engines, BMW can manage it without cheating tests.

Moan, moan, moan.

I find it typical of the VW hierarchy that they release a VIN checker for the VW brand well before they climb down off their high-horse and provide Skoda with the equipment to do likewise.  The Skoda checker is nothing to do with emissions - just a recall checker with a disclaimer around accuracy.  I bought a Superb II 4x4 TDi 170 just before I became aware of this.  As I was stepping out of a 500bhp car for one that could easily accommodate the kids, one of the few crumbs of comfort for me personally was that it was into a "cleaner" vehicle (which it probably still is, just not as much so).  I find the lack of information extremely difficult to tolerate, especially when we know VW owners are now able to check whether they're affected just by typing in a VIN (now the website isn't crashing every time you try to get in because of the DDoS effect of so many people looking.

 

While the emissions thing isn't too bad overall in terms of my perception of the brand, the lack of Skoda info makes me feel the brand is very much bottom of the VAG pile (no jokes about being underneath a VAG please) and I'm about to phone some lawyers and get added to that class action, simply because there's nothing else I can do.  A little info would have prevented this as I would have known whether I can get away with mapping the car now or have to leave it until after the "fix" has been implemented (yes, cheating and increasing emissions as I did so).

 

Who knows, maybe it's a Skoda admin thing but if they can do it for VW, they should do it for all the brands at the same time - or are we not valued customers of the group?

To me everything is in flux and I wouldn't waste my time on any VW site at the moment.

I imagine management need complaints about their 'info sites' like a hole in the head.

There is a VIN Checker for Volkswagen Group car and this Emissions Issue in Ireland.

So seeing as Ireland is in Europe and the VIN No.s for Europe include UK Cars, maybe try it.

It;s possibly that they may be prosecuted even if they didn't know (or it can't be proved that they knew, directed or authorised such measures) since as executive board emembers they hold legal responsibility for the company.

 

I suppose the questions then would be "Should they have known?" or "Did their decisions directly lead to the development and installation of the 'defeat devices'?".

 

I'm still amazed that this didn't leak out. There must have been hundreds of people in the know.

Thankyou @goneoffSKion1.  I finally got the answer I very strongly suspected (wouldn't have believed it wasn't affected anyway).  Sorry Skoda - not that far behind the 8-ball after all!  I'm now having to wait to get my remap which will hurt in ways I can't describe so please hurry up with this repair or you'll have a claim for emotional distress on your hands....  Question - will remaps take emissions over the edge after repair or will they just write the cheat software back onto the ECU?  I want to try to take a file image of the entire ECU so I can put the software back on.  FYI my VIN search produced this:

They just lack the part where they say,

 

 'We will do all the work at our expense and recompense you for any costs involved in getting the vehicle to us, 

or alternatively we will arrange collection, delivery of a courtesy vehicle and then the return of your vehicle'.

 

But,

'SKODA will cover the costs relating directly to this repairs'  might mean just that.

 

People have vehicles on Islands that are part of the British Isles and no VWG Official Dealerships near,

when it comes to Warranty work they often more or less say 'tough', 

so with VWG this time owners need to show them 'tough love'.  they can pay to sort their mess.

 

If it is just a Diagnostic Plug in and then a Software Update or Enhancement required.,

they can get Mobile Facilities (Vans) and Technicians to visit Vehicles at a place that suits the Owners.

Home, Work Place etc.  Put them selves out a bit.

'Simply Clever'.

My Superb Greenline III, first registered December 2013, is affected according to the VIN checker.

 

Note that below the checker are boxes to enter your details to send to Skoda.  I don't know whether this will result in them contacting affected owners sooner, but I've tried it in hope!  :sweat:   :thumbdown:

Halloweencostumes.com has released instructions on how to create your own dieselgate-inspired Halloween costume.   Created using a variety of different components - including a Video Game Car costume, a deluxe smoke mask, spider web decor, a toilet paper tube and black spray paint - the costume is being billed as one of the year's  best "attention getting cringe costume" ideas.  The assembly process is relatively straight forward as the only major change is the creation of a tailpipe with a diesel exhaust plume.  This involves making a fluffy 'cloud' of spider webbing, spray painting it black and then attaching it to the car costume via the toilet paper tube which doubles as a tailpipe.
